While issuing notice to the government and Fssai, Justice Amit Mahajan said Dabur has made out a prima facie case for grant of stay of Monday’s ban order, as such sudden restrictions could not have been imposed without issuing a show-cause notice or hearing the company.
Senior counsel Sandeep Sethi, appearing for Dabur, argued that Fssai’s order was passed without following principles of natural justice. The company has been selling these products for decades, he said, also arguing that the officer who passed the order did not have the power to prohibit the sale of these products in the manner in which it was done.
Fssai counsel Ashish Dixit opposed Dabur’s stand, arguing that the regulator had issued an improvement notice to the company asking it to make changes and not to use such claims in products like Dabur’s Real Juice.
