The company has agreed to a proposed settlement covering approximately 76,000 lawsuits alleging that its talc-based baby powder and other talc products caused ovarian cancer.
The agreement could resolve 99.75% of the remaining ovarian cancer claims against Johnson & Johnson in the United States. However, it will become final only if at least 95% of eligible claimants accept its terms.
Initial payments of up to $3 billion are expected to begin in 2027, with additional payouts extending into 2028. The total amount paid could eventually exceed $7 billion, depending on claimant participation and individual case valuations.

$5.5 Billion Deal Covers Existing Ovarian Cancer Claims
The proposed settlement focuses primarily on existing ovarian cancer lawsuits filed in U.S. federal and state courts.
It does not resolve every talc-related case against Johnson & Johnson. Lawsuits involving mesothelioma, a cancer associated with asbestos exposure, have been handled separately.
Johnson & Johnson says it has already settled most of the mesothelioma cases filed against the company, along with several consumer-protection claims and disputes involving former talc suppliers.
Unlike the company’s previous bankruptcy proposals, the latest settlement does not prevent people from filing new lawsuits in the future. It is designed to compensate eligible women and families who have already brought ovarian cancer claims.
Lawyers representing thousands of claimants described the agreement as a long-awaited resolution after years of trials, appeals and legal uncertainty.

Johnson & Johnson Continues to Deny Cancer Claims
Despite proposing the multibillion-dollar settlement, Johnson & Johnson continues to deny that its talc products caused ovarian cancer or contained asbestos.
Erik Haas, the company’s worldwide vice president of litigation, called the claims “meritless” and said the agreement was intended to provide closure after years of litigation.
The company maintains that its talc products were safe, asbestos-free and supported by scientific evidence. It also stressed that the settlement does not represent an admission of wrongdoing or liability.
Johnson & Johnson said it believed it could eventually prevail in court but chose settlement to provide greater certainty for the company and affected claimants.
The agreement also follows a federal court ruling that questioned whether expert witnesses for the plaintiffs had provided sufficient scientific evidence linking talc exposure to individual ovarian cancer cases.

Rejected Bankruptcy Plans Led to Direct Settlement
Johnson & Johnson previously attempted to resolve its talc liabilities by transferring them to subsidiary companies that later sought bankruptcy protection.
The controversial legal strategy was widely described as the “Texas two-step.” Critics argued that a financially stable company should not be allowed to use bankruptcy proceedings to limit its exposure to personal-injury lawsuits.
Courts rejected three bankruptcy attempts, including a proposed settlement valued at approximately $9 billion.
The judges concluded that the subsidiaries carrying the talc liabilities were not experiencing the level of financial distress required to qualify for bankruptcy protection. Following the latest rejection, Johnson & Johnson decided not to appeal and returned to direct negotiations with lawyers representing the claimants.
The new settlement provides faster payments but covers a narrower group than the previous bankruptcy proposals, which also attempted to resolve potential future claims.()
Talc Litigation Began More Than a Decade Ago
The lawsuits began more than a decade ago when women who had regularly used Johnson’s Baby Powder for feminine hygiene claimed that long-term talc exposure increased their risk of ovarian cancer.
Another group of plaintiffs alleged that some talc products contained asbestos, a known carcinogen that can cause mesothelioma and other serious diseases.
The litigation grew into one of the largest mass-tort cases in the United States. Plaintiffs accused Johnson & Johnson of knowing about potential health risks but failing to warn consumers.
The company has repeatedly rejected those accusations and maintained that decades of scientific testing confirmed the safety of its products. More than 76,000 ovarian cancer claims are now expected to be covered by the proposed agreement.
Major Verdicts Shaped the Talc Legal Battle
One of the earliest major verdicts awarded $72 million to the family of Jacqueline Fox, who died from ovarian cancer after decades of talc use. Although the verdict was later overturned, it drew widespread attention and encouraged thousands of women to file similar lawsuits.
A California jury later awarded $417 million to Eva Echeverria, who claimed that long-term Baby Powder use caused her ovarian cancer. That verdict was also subsequently overturned.()
One of the largest awards came in Missouri, where a jury awarded $4.69 billion to 22 women who alleged that Johnson & Johnson had failed to warn consumers about asbestos in its talc products.
The award was later reduced to approximately $2.1 billion on appeal. Johnson & Johnson has also won several cases and successfully overturned or reduced other verdicts, resulting in a mixed legal record across different courts.
Scientific Evidence on Talc and Ovarian Cancer Remains Complex
The scientific debate largely depends on whether talc is contaminated with asbestos and how consumers were exposed to it. Talc and asbestos can occur naturally near each other underground. Asbestos is a recognised human carcinogen, making careful mining, processing and testing essential for talc used in cosmetics.
In 2024, the International Agency for Research on Cancer classified talc as “probably carcinogenic to humans.” The classification was based on limited evidence for ovarian cancer in humans, sufficient evidence from animal studies and strong mechanistic evidence.
However, a hazard classification does not establish how much risk a particular talc product or pattern of consumer use presents.
Some observational studies have found an association between genital talc use and ovarian cancer, while others have reported inconsistent results or insufficient evidence to prove a direct causal relationship.()
The American Cancer Society states that asbestos-containing talc can cause cancer when inhaled, but the evidence concerning asbestos-free talc remains less clear. The U.S. Food and Drug Administration continues to test talc-containing cosmetics for possible asbestos contamination.
Talc-Based Baby Powder Has Been Discontinued
Johnson & Johnson stopped selling talc-based baby powder in the United States and Canada in 2020 and discontinued it globally in 2023. The product was replaced with a cornstarch-based formulation.
The company said the decision reflected declining demand, changing consumer preferences and misinformation surrounding talc safety.
Johnson & Johnson has consistently maintained that discontinuing talc-based Baby Powder was not an acknowledgment that the product caused cancer.
Claimant Approval Will Determine the Settlement
The settlement will move forward only if at least 95% of eligible claimants approve the agreement. If the required participation threshold is reached, compensation will be determined using factors such as the claimant’s diagnosis and individual circumstances.
Initial payments are expected to begin in 2027, with further payouts scheduled from 2028. If the settlement fails to receive sufficient support, Johnson & Johnson could return to defending the remaining lawsuits individually in federal and state courts.
The proposed agreement may provide financial closure for thousands of women and their families. However, it is unlikely to end the wider scientific and public-health debate over talc, asbestos contamination and ovarian cancer risk.
