Tesla is suing the Canadian province of Manitoba for cutting the automaker out of its electric vehicle rebate program, and the fight has now reached a courtroom.
The province is asking Manitoba’s Court of King’s Bench to throw out the challenge. Tesla says the ban has already cost its Canadian customers at least $560,000 in lost rebates.
Why Manitoba cut Tesla off
Manitoba launched its C$25 million EV rebate program in the summer of 2024, offering buyers up to $4,000 off a new EV priced under $70,000 and $2,500 off a used one.
Then, in its March 2025 budget, the NDP government dropped Tesla and Chinese-made vehicles from the eligibility list. It wasn’t subtle about why. Finance Minister Adrien Sala framed the move as “Trump-proofing” the economy and an “elbows up” response to U.S. tariffs. Premier Wab Kinew was blunter, tying it directly to Elon Musk’s support for President Trump’s actions against Canada: “we cut him off.”
Here’s the awkward part. Tesla was the single biggest winner in the program before it got booted. Court documents obtained through freedom-of-information requests show Tesla vehicles took 337 rebates worth roughly $1.3 million between August 2024 and February 2025 — more than 20% of every EV rebate the province handed out.
It’s been a rough stretch for Tesla and Canadian incentives generally. Earlier in 2025, the automaker was banned from Canada’s federal EV rebate program after filing a suspicious number of last-minute claims as that program wound down.
What Tesla is arguing
Tesla filed for judicial review in June, and its case leans on process. The company says the exclusion was unreasonable, untransparent, and unfair. It says it was never given a formal explanation, doesn’t know which official made the call or whether they even had the authority, and learned about the decision through media reports.
The core of the argument is that Tesla was singled out. No other automaker with a U.S. parent company was cut from the program — only Tesla. The company also points out that it’s registered as a Canadian corporation in Nova Scotia and employs Canadians here.
Tesla wants two things: reinstatement in the program, and retroactive rebates paid out to customers who bought a Tesla after the cutoff.
The Ontario precedent hanging over the case
Tesla has run this play before, and won. In 2018, Ontario’s Ford government wound down its EV rebate but structured the transition to leave Tesla out. Tesla sued, and a judge ruled the treatment “arbitrary and unlawful,” forcing the province to pay eligible Tesla buyers before the program ended.
The stakes reach past Manitoba. British Columbia, Nova Scotia, and Prince Edward Island all excluded Tesla from their own rebate programs in 2025 on similar trade-tension grounds. A win here would give Tesla a template to challenge all of them.
